1. Who we are

This website is maintained by CHAMELLA SOFTWARE LTDA, registered under CNPJ (Brazilian company taxpayer ID) no. 22.094.356/0001-74, headquartered at Rua Diamantina, 615, Bairro das Capitais, Timbó/SC, CEP 89095-223, Brazil, e-mail contato@chamella.com.br ("Chamella"), in compliance with art. 2º of Decreto nº 7.962/2013.

2. About these terms

These Terms of Use govern access to and use of the website chamella.com.br. By browsing the website, you state that you have read these terms. If you do not agree with them, do not use the website.

The processing of personal data is described in our Privacy Policy, which is part of these terms.

3. What the website is (and what it is not)

The website is institutional: it presents Chamella, the services it provides and content about paid traffic, SEO and e-commerce. No service is contracted through the website.

  • Engaging any service depends on a commercial proposal and a written contract, which define scope, deadlines, prices and conditions.
  • Past results do not guarantee future results. Each store's performance depends on factors such as product, price, competition, media investment and platform rules (Google, Meta, TikTok and others), which are beyond Chamella's control.
  • The blog articles are for information only and do not replace a specific analysis of your operation. Numerical examples in the articles are illustrative and are identified as such.

Nothing in these terms excludes the rights that the Brazilian Consumer Protection Code grants to anyone who qualifies as a consumer.

4. Permitted use

You may browse the website, read and share the links to its pages and articles. You may not:

  • copy, reproduce, modify or distribute Chamella's texts, images, layout, brand or logo without written authorization, except for quoting excerpts with the source indicated, within the limits of art. 46 of Lei nº 9.610/1998;
  • use bots or automated tools that overload the website or copy its content in bulk;
  • try to access restricted areas, exploit security flaws or interfere with the website's operation;
  • use the forms to send unlawful, offensive or false content, or content on behalf of another person.

5. Intellectual property

The Chamella brand, the logo (chameleon emblem), the texts, the layout and the other content of the website belong to Chamella or are used with authorization, and are protected by Lei nº 9.279/1996 (industrial property) and by Lei nº 9.610/1998 (copyright). Using the website does not transfer to you any rights over this content.

Third-party brands mentioned on the website (Google, Meta, TikTok, Shopify, VTEX, Nuvemshop, WooCommerce, Tray, Adobe and others) belong to their owners and are mentioned only to identify the platforms Chamella works with, without indicating an official partnership, unless expressly stated.

6. Links to other websites

The website has links to third-party services, such as WhatsApp. When you follow them, you use those services under their terms and policies. Chamella does not control the content or practices of those websites.

7. Availability and liability

Chamella strives to keep the website available and its information up to date, but the website may go offline for maintenance or due to technical failures, and some content may become outdated.

To the extent permitted by law, Chamella is not liable for decisions made solely on the basis of the informational content of the website, without engaging a specific analysis. This clause does not apply in cases where the law does not allow liability to be limited, in particular in consumer relationships (art. 51, I, of the Brazilian Consumer Protection Code).

8. Changes to these terms

These terms may be updated. The version in force is always the one published on this page, with the update date at the top.

9. Governing law and jurisdiction

These terms are governed by Brazilian law, in particular the Brazilian Internet Civil Framework and the Brazilian Consumer Protection Code.

The courts of the judicial district of Timbó/SC, Brazil, are chosen to resolve any matter related to these terms. If you qualify as a consumer, you may file the claim in the courts of your domicile, in accordance with art. 101, I, of the Brazilian Consumer Protection Code.
